In case you want tenants in Halifax to move out your West Yorkshire property, you must maintain strict rules.
The conditions for the tenancy agreement determine the actual process of eviction in Northowram, Brighouse, or Hipperholme.
The two forms of secured shorthold tenancies in Halifax, West Yorkshire are:
Tenancies that are 'periodic' in Halifax - these run on a weekly or monthly basis with a date that is not fixed
Halifax Fixed-term tenancies: these run for a given time
In case your West Yorkshire tenants have an ensured shorthold tenancy in Brighouse, Hipperholme, or Northowram, you must follow an amount of procedures.
1. If you want the property in Halifax back after a fixed term ends, give your tenants in West Yorkshire a notice of Section 21, and give them a Section 8 notice if the terms of the tenancy have been broken.
2. Next, apply to the West Yorkshire court for a standard possession order if your tenants in Halifax owe you house rent, and they do not vacate the property by the date specified on the notice, however, you can request for an accelerated possession order if you don't intend to claim any unpaid rent.
3. If the tenants in Hipperholme, Northowram, or Brighouse refuse to vacate, apply for the warrant possession and the bailiffs will surely evict the tenants in Halifax from your rental premises.
If they have an exempt lease or warrant, for example when they stay with you, you don't have to go to trial to evict your guests in Halifax.
Simply give the tenant reasonable eviction notice.
Reasonable notice means the tenant must vacate the property by the end of the payment period, so if your tenants pay rent monthly, you can give them one-month notice.
The notice can be verbal, does not need to be in writing.
You may change locks in their rooms in Brighouse, Hipperholme, or Northowram, even if they still have belongings inside.
Halifax tenants, who started their tenancy before 27 February 1997, may have an assured or regulated tenancy.
You will then have to go through another set of rules to evict them in West Yorkshire as their eviction protection is increased.
If the Halifax occupant has left their possessions on the rental premises in Northowram, Brighouse, or Hipperholme, there are certain procedures in place to deal with them.
If your tenant has pending rent and enjoy Universal Credit or Housing Benefit, then you may be able to get the pending rent instead of evicting the tenants in Halifax.
This is referred to as 'Managed Payments' in West Yorkshire.
You can ask for managed payments if your tenant in Halifax is claiming:
Universal Credit - You will need to apply to the Department for Work & Pensions
Housing Benefit - the local council in West Yorkshire can help you that offers benefits to your tenants
